This Privacy Policy explains how AiGeniusLLC (“AiGenius,” “we,” “us” or “our”) collects, uses, shares and protects your personal information when you visit academy.aigenius.cloud or use AiGenius Academy (the “Service”). We are committed to compliance with the EU General Data Protection Regulation (GDPR) and the California Consumer Privacy Act (CCPA) as amended by the CPRA.

1. Information we collect

We collect information in three ways:

  • Information you give us — name, email address, billing details, course preferences, support messages, learner age (for the Kids plan) and any other information you submit through our forms.
  • Information collected automatically — IP address, browser type and version, device identifiers, pages visited, referring URLs, and session duration, collected via cookies and similar technologies.
  • Information from third parties — payment confirmations from our payment processor, identity verification (where required), and analytics data from privacy-respecting providers.

2. How we use your information

  • To provide, maintain and improve the Service, including delivering courses and AI tutor responses.
  • To process payments and manage subscriptions.
  • To communicate with you about your account, the Service and (with your consent) product updates.
  • To monitor and improve performance, prevent abuse and maintain security.
  • To comply with legal obligations.

3. Legal bases for processing (GDPR)

For users in the European Economic Area and the United Kingdom, our legal bases for processing your personal data are: performance of a contract (to provide the Service), your consent (e.g. marketing emails), our legitimate interests (e.g. fraud prevention, service improvement) and compliance with our legal obligations.

4. Cookies and similar technologies

We use cookies for essential functionality (authentication, security, preferences), analytics (aggregate usage statistics) and, with your consent, occasional marketing. You can manage cookie preferences at any time from your browser settings. We do not use cross-site advertising trackers.

5. Sharing your information

We do not sell your personal information. We share it only with:

  • Service providers who process data on our behalf — including payment processing, cloud hosting, video delivery and AI tutoring — under strict data-processing agreements.
  • Legal or regulatory authorities where required by applicable law.
  • Successors in the event of a merger, acquisition or sale of assets, in which case affected users will be notified.

6. International data transfers

AiGeniusLLC is based in the United States. Personal data we collect may be transferred to and processed in countries other than the country you live in. For transfers from the EEA/UK, we rely on Standard Contractual Clauses and equivalent safeguards.

7. Data retention

We retain your information only as long as necessary to provide the Service, comply with legal obligations, resolve disputes and enforce our agreements. Waitlist data is retained for up to 24 months after collection unless you ask us to delete it sooner.

8. Your rights

Depending on where you live, you may have the following rights:

  • Access — request a copy of the personal data we hold about you.
  • Correction — ask us to correct inaccurate or incomplete information.
  • Deletion — ask us to delete your personal data, subject to legal exceptions.
  • Restriction and objection — limit or object to certain processing.
  • Portability — receive your data in a portable format.
  • Withdraw consent — at any time, where processing is based on consent.
  • Opt out of sale or sharing — California residents: we do not sell or share your data for cross-context behavioural advertising.

9. Children's privacy

For learners under 13 (and 16 in some jurisdictions), we require verifiable parental consent in line with COPPA. We collect only the information necessary to provide the Service to the child. Parents may review, correct or delete their child's information at any time by contacting us.

10. Security

We implement administrative, technical and physical safeguards designed to protect your personal data, including encryption in transit and at rest, role-based access controls, regular security reviews and infrastructure hosted on enterprise-grade cloud platforms.

11. Changes to this policy

We may update this Privacy Policy from time to time. Material changes will be notified by email or via a prominent notice on the Service. The “Last updated” date at the top of this page indicates when the policy was last revised.
